1. TARAFLAR

Vibeo adlı mobil uygulama ("Uygulama") ve bağlı internet siteleri ("İnternet Siteleri"), 888 TECHNOLOGY, LLC ("Şirket") tarafından işletilmektedir. İnternet Sitelerinden ve/veya Uygulamadan herhangi bir şekilde yararlanan herkes "Kullanıcı" olarak anılacaktır. İşbu "Kullanım Koşulları" ("Koşullar") kapsamında, 888 TECHNOLOGY, LLC ve Kullanıcı ayrı ayrı "Taraf" ve birlikte "Taraflar" olarak, İnternet Siteleri ve Uygulama birlikte ("Platform") olarak anılacaktır.

2. KOŞULLARIN KAPSAMI VE KONUSU

İşbu Koşullar, Platform üzerinden sağlanan hizmetlerin sunulma şeklini, hizmet koşullarını ve Tarafların karşılıklı hak ve yükümlülüklerini düzenlemektedir.

Vibeo, içerik üreticileri için AI destekli viral hook generator platformudur. Platform aşağıdaki hizmetleri sunmaktadır:

• AI destekli viral hook üretimi (video ve görsel tabanlı dikkat çekici açılışlar)
• Video analizi ve viral potansiyel skorlama (0-100 arası viralite skoru)
• Hook forklama — mevcut hookları remiks yaparak yeni içerik oluşturma
• Video fikir üretimi — AI ile içerik fikirleri, senaryo ve hook geçişleri oluşturma
• Discover akışı — diğer içerik üreticilerin hooklarını keşfetme, beğenme ve kaydetme
• İçerik iyileştirme önerileri ve engagement stratejileri

3. KOŞULLARIN KABULÜ VE UYGULANMASI

Platforma giriş yapılması ve/veya herhangi bir şekilde erişim sağlanması, Koşulların Kullanıcı tarafından kabul edildiği anlamına gelir. Kullanıcı, Platformu kullanmadan önce işbu Koşulları okuyup incelemelidir.

Şirket, Koşulları güncelleme ve değiştirme hakkını saklı tutar.

4. KAYIT VE UYGUNLUK

Platforma kayıt olurken Kullanıcı doğru, eksiksiz ve güncel bilgi sağlamakla yükümlüdür. Platforma kaydolarak veya Platformu kullanarak, Kullanıcı aşağıdakileri beyan ve taahhüt eder:

• 13 yaşından büyük olduğunu.
• Platformu kullanmanın herhangi bir yasa veya düzenlemeyi ihlal etmediğini.
• Platformu kendi adına kullandığını ve başka bir kişi yerine kayıt olmadığını.
• Platformda daha önce askıya alınmış bir hesabının bulunmadığını.

5. KULLANICININ HAK VE YÜKÜMLÜLÜKLERİ

Kullanıcı, Platformu kullanırken yürürlükteki tüm mevzuata, işbu Koşullara ve dürüstlük ilkelerine uymayı kabul ve taahhüt eder. Kullanıcı ayrıca:

• Platformun işleyişini engelleyecek veya aksatacak faaliyetlerde bulunmayacaktır.
• Başkalarının videolarını veya içeriklerini izinsiz olarak yüklemeyecektir.
• Platformda virüs, kötü amaçlı yazılım veya zararlı kod dağıtmayacaktır.
• API'leri izinsiz kullanmayacak veya tersine mühendislik yapmayacaktır.
• Otomatik bot, scraper veya benzeri araçlar kullanmayacaktır.
• Uygunsuz, müstehcen, şiddete teşvik eden veya hakaret içeren içerik yüklemeyecektir.
• AI tarafından üretilen içerikleri yanıltıcı veya zararlı amaçlarla kullanmayacaktır.

Platform üzerindeki tüm fikri mülkiyet hakları (tasarım, yazılım, içerik, logo ve markalar dahil) Şirkete aittir.

6. KULLANICI İÇERİĞİ

• Kullanıcının Platforma yüklediği videolar ve içerikler Kullanıcıya aittir.
• Kullanıcı, Platformu kullanarak içeriklerinin AI işlemesi amacıyla Şirketin hizmet sağlayıcılarına gönderilmesine izin vermiş olur.
• Yüklenen içerikler yalnızca Platform hizmetleri kapsamında kullanılır ve pazarlama amacıyla üçüncü taraflarla paylaşılmaz.
• Kullanıcı, yüklediği tüm içeriklerin kendi mülkiyetinde olduğunu veya yükleme hakkına sahip olduğunu beyan ve taahhüt eder.

7. ABONELİK PLANLARI, AI HİZMETLERİ VE KREDİ SİSTEMİ

Platform, haftalık ve yıllık abonelik planları sunar. Abonelik planları uygulama içi satın alma (In-App Purchase) yoluyla RevenueCat altyapısı üzerinden işlenir.

Platform içi AI işlemleri kredi sistemi ile çalışır:

• Her Kullanıcıya kayıt sırasında hoş geldin kredisi verilir.
• Abonelik planına göre belirli miktarda kredi tahsis edilir.
• AI işlemleri (hook üretimi, hook forklama, video analizi, video fikir üretimi vb.) işlem başına belirlenmiş miktarda kredi harcar.
• Krediler sosyal medya takibi, davet (referral) ve diğer etkinliklerle de kazanılabilir.
• Krediler nakit değere sahip değildir ve iade edilemez.
• Kullanılmayan krediler abonelik dönemi sonunda sıfırlanabilir.

AI tarafından üretilen hooklar, analizler, video fikirleri ve öneriler yalnızca tavsiye niteliğindedir. AI sonuçlarının doğruluğu garanti edilmez. Üretilen içeriklerin kullanım sorumluluğu tamamen Kullanıcıya aittir.

8. ŞİRKETİN HAK VE YÜKÜMLÜLÜKLERİ

Şirket aşağıdaki haklara sahiptir:

• Kullanıcıların Platform kullanımını denetlemek ve gerekli önlemleri almak.
• Platform üzerinde tek taraflı olarak değişiklik yapmak, hizmetleri güncellemek veya kaldırmak.
• İşbu Koşulları ihlal eden kullanıcı içeriklerini düzenlemek veya kaldırmak.
• 6 (altı) aydan uzun süredir aktif olmayan hesapları sonlandırmak.
• Kötü amaçlı veya yasadışı faaliyetleri tespit etmek için otomatik teknoloji kullanmak.

9. SORUMLULUK SINIRLAMASI

Şirket, Platformun kullanımından kaynaklanan doğrudan veya dolaylı zararlardan sorumlu değildir. Platformun kesintisiz veya hatasız çalışacağı garanti edilmez.

AI işlem sonuçları "olduğu gibi" sunulur ve Şirket bu sonuçların doğruluğu, eksiksizliği veya belirli bir amaca uygunluğu konusunda herhangi bir garanti vermez.

10. SATIN ALMALAR VE ABONELİK

Platform, haftalık ve yıllık abonelik planları sunar. Kullanıcı, seçtiği abonelik planına ait ücreti ödemeyi kabul eder. Ödemeler, Apple App Store veya Google Play Store üzerinden uygulama içi satın alma (In-App Purchase) olarak gerçekleştirilir.

• Abonelik hizmetleri, iptal edilene kadar otomatik olarak yenilenir.
• Abonelik iptali, mevcut dönem sona erene kadar hizmet kesintisine neden olmaz.
• Abonelik yönetimi ve iptali, kullanıcının cihaz ayarlarındaki mağaza abonelik bölümünden yapılır.
• Ücretsiz deneme süresi sunulması halinde, deneme süresi sonunda abonelik otomatik olarak ücretli plana geçer (iptal edilmediği takdirde).
• Satın alınan abonelikler, aynı mağaza hesabıyla "Satın Alımları Geri Yükle" seçeneği ile geri yüklenebilir.

11. KOŞULLARIN DEĞİŞTİRİLMESİ

Şirket, işbu Koşulları herhangi bir zamanda tek taraflı olarak değiştirebilir. Değişiklikler, Platform üzerinde yayımlandığı tarihte yürürlüğe girer.

12. UYUŞMAZLIKLARIN ÇÖZÜMÜ

İşbu Koşullar Wyoming eyaleti kanunlarına tabidir. Uyuşmazlıkların çözümünde Wyoming eyaleti mahkemeleri yetkilidir.

13. HESAP SONLANDIRMA

Kullanıcı, hesabını istediği zaman Uygulama içinden silebilir. Hesap silindiğinde, Kullanıcının kişisel verileri Gizlilik Politikasında belirtilen süre içinde sistemlerden kaldırılır.

Şirket, işbu Koşulların ihlali durumunda herhangi bir Kullanıcının hesabını önceden bildirimde bulunmaksızın askıya alma veya kalıcı olarak sonlandırma hakkını saklı tutar.

14. ÇOCUK GÜVENLİĞİ POLİTİKASI

• Vibeo, çocuk istismarı içeriğine (CSAM) karşı sıfır tolerans politikası uygulamaktadır.
• Platform, 13 yaşından büyük kullanıcılar için tasarlanmıştır.
• Kullanıcılar, uygunsuz içerikleri uygulama içi raporlama mekanizması aracılığıyla bildirebilir.
• Platform, uluslararası çocuk koruma mevzuatına uyumludur.

15. YÜRÜRLÜK

İşbu Koşullar, Kullanıcının Platforma eriştiği andan itibaren bağlayıcıdır.

1. PARTIES

The mobile application named Vibeo ("Application") and associated websites ("Websites") are operated by 888 TECHNOLOGY, LLC ("Company"). Anyone who benefits from the Websites and/or Application in any way will be referred to as a "User". Within the scope of these "Terms of Use" ("Terms"), the Websites and Application together will be referred to as ("Platform").

2. SCOPE AND SUBJECT OF THE TERMS

These Terms govern the manner in which services are provided through the Platform, the conditions of service, and the mutual rights and obligations of the Parties.

Vibeo is an AI-powered viral hook generator platform for content creators. The Platform provides the following services:

• AI-powered viral hook generation (video and image-based attention-grabbing openings)
• Video analysis and viral potential scoring (virality score from 0-100)
• Hook forking — remixing existing hooks to create new content
• Video idea generation — AI-powered content ideas, scripts and hook transitions
• Discover feed — exploring, liking and saving hooks from other content creators
• Content improvement suggestions and engagement strategies

3. ACCEPTANCE AND APPLICATION OF THE TERMS

Entry to the Platform and/or access in any way means that the Terms have been accepted by the User. The User must read and review these Terms before using the Platform.

The Company reserves the right to update and modify the Terms.

4. REGISTRATION AND ELIGIBILITY

The User is obligated to provide accurate, complete, and current information when registering on the Platform. By registering on or using the Platform, the User represents and warrants that:

• They are over 13 years of age.
• Their use of the Platform does not violate any law or regulation.
• They are using the Platform on their own behalf and have not registered on behalf of another person.
• They do not have a previously suspended account on the Platform.

5. USER'S RIGHTS AND OBLIGATIONS

The User agrees and undertakes to comply with all applicable legislation, these Terms, and principles of good faith while using the Platform. The User also:

• Shall not engage in activities that would prevent or disrupt the operation of the Platform.
• Shall not upload videos or content belonging to others without their permission.
• Shall not distribute viruses, malware, or harmful code on the Platform.
• Shall not use APIs without authorization or engage in reverse engineering.
• Shall not use automated bots, scrapers, or similar tools.
• Shall not upload inappropriate, obscene, violence-inciting, or defamatory content.
• Shall not use AI-generated content for misleading or harmful purposes.

All intellectual property rights on the Platform (including design, software, content, logos, and trademarks) belong to the Company.

6. USER CONTENT

• Videos and content uploaded to the Platform by the User belong to the User.
• By using the Platform, the User consents to their content being sent to the Company's service providers for the purpose of AI processing.
• Uploaded content is used only within the scope of Platform services and is not shared with third parties for marketing purposes.
• The User represents and warrants that all content they upload is their own property or that they have the right to upload it.

7. SUBSCRIPTION PLANS, AI SERVICES AND CREDIT SYSTEM

The Platform offers weekly and yearly subscription plans. Subscription plans are processed via in-app purchase through RevenueCat infrastructure.

In-platform AI operations work with a credit system:

• Each User receives welcome credits upon registration.
• A specified amount of credits is allocated based on the subscription plan.
• AI operations (hook generation, hook forking, video analysis, video idea generation, etc.) consume a specified amount of credits per operation.
• Credits can also be earned through social media follows, referrals and other activities.
• Credits have no cash value and are non-refundable.
• Unused credits may reset at the end of the subscription period.

Hooks, analyses, video ideas and suggestions generated by AI are advisory in nature only. The accuracy of AI results is not guaranteed. The responsibility for using generated content lies entirely with the User.

8. COMPANY'S RIGHTS AND OBLIGATIONS

The Company has the following rights:

• To supervise Users' use of the Platform and take necessary measures.
• To make unilateral changes to the Platform, update or remove services.
• To edit or remove user content that violates these Terms.
• To terminate accounts that have been inactive for more than 6 (six) months.
• To use automated technology to detect malicious or illegal activities.

9. LIMITATION OF LIABILITY

The Company is not responsible for direct or indirect damages arising from the use of the Platform. The Platform is not guaranteed to operate without interruption or error.

AI processing results are provided "as is" and the Company makes no warranties regarding the accuracy, completeness, or fitness for a particular purpose of these results.

10. PURCHASES AND SUBSCRIPTION

The Platform offers weekly and yearly subscription plans. The User agrees to pay the fee for their selected subscription plan. Payments are processed as in-app purchases through the Apple App Store or Google Play Store.

• Subscription services are automatically renewed until canceled.
• Cancellation of a subscription does not cause service interruption until the current period ends.
• Subscription management and cancellation is done through the store subscription section in the user's device settings.
• If a free trial period is offered, the subscription will automatically convert to a paid plan at the end of the trial period (unless canceled).
• Purchased subscriptions can be restored using the "Restore Purchases" option with the same store account.

11. MODIFICATION OF THE TERMS

The Company may unilaterally change these Terms at any time. Changes take effect on the date they are published on the Platform.

12. RESOLUTION OF DISPUTES

These Terms are governed by the laws of the State of Wyoming. Wyoming state courts have jurisdiction over the resolution of disputes.

13. ACCOUNT TERMINATION

The User can delete their account at any time from within the Application. Upon account deletion, the User's personal data will be removed from the systems within the period specified in the Privacy Policy.

The Company reserves the right to suspend or permanently terminate any User's account without prior notice in case of violation of these Terms.

14. CHILD SAFETY POLICY

• Vibeo has a zero-tolerance policy for child sexual abuse material (CSAM).
• The Platform is designed for users over the age of 13.
• Users can report inappropriate content through the in-app reporting mechanism.
• The Platform complies with international child protection legislation.

15. EFFECTIVE DATE

These Terms are binding upon the User from the moment they access the Platform.
